e-mailing us. Thank you for the time to contact us. Over ninety-nine percent of all Florida homes are not protected under the Florida homestead asset protection laws. Unfortunately, your existing home and residence probably does not possess protections afforded under the Florida homestead law, as you may have assumed! Under Florida law, the exemption of a homestead from seizure and sale for debts is a different thing from the exemption to the extent of $50,000 of a homestead appraisal reduction from taxation, and a homestead as defined for tax purposes, is not necessarily a homestead that is "non-devisable" or not able to be disposed of by law. To put it another way, the exemption of a homestead from forced sale, or a of home equity, and from having a judgment or execution being a lien thereon differs from homestead property tax exemption, as defined for ad valorem (which means 'according to value') property tax purposes. Here is the State’s answer to our specific inquiries about our services...
 
OUR QUESTIONS TO THE STATE OF FLORIDA DEPARTMENT OF REVENUE REGARDING FLORIDA ‘HOMESTEAD EXEMPTION’:
Question 1: “By claiming homestead property ad valorem tax exemption through the local county property appraiser’s office, how does that declare and protect my real property and equity as a true, legal homestead?” 
Answer: “The property tax exemption is in regards to, and applies only to, and for the real estate property tax bill and is a combined notice of ad valorem taxes and non-ad valorem real estate tax assessments.”
 
Question 2: “Does this ‘property tax exemption’ protect my real property and its equity, against liens, judgments, levy and/or foreclosure as a valid or claimed homestead, or does it just qualify a homeowner to receive a property ‘tax break’? Please have your office clarify my question; Does any Florida county property appraiser’s homestead property tax exemption form, specifically and clearly designate and record my real property as a qualified and claimed homestead property, or is its main purpose just for the homestead exemption assessment portion of ad valorem property taxes?”
Answer: “When you receive a ‘homestead tax exemption’ from your county property appraiser’s office, its only purpose is to save you money on the first twenty-five thousand dollars of your real estate ad valorem property taxes, and to cap the assessed property value to no more than a 3% increase per year under the Save Our homes Act. It does not protect your home or equity from creditors and judgment executions, which is also not automatic.”

The exceptions to the law are a secured mortgage, property tax liens and a lien for contract for improvement of the property. Protection of a homestead is not automatic and must be claimed separately than the ‘homestead tax exemption’. Protection of homestead is by individual choice and by an individual’s own initiative, not by the duties of the property appraiser’s office in the county in which an individual resides. Absent notice that we are in need of this protection against forced sale of our homes, few of us are likely to make a homestead claim just in case it might prove handy some day. 

The real property homestead claim can be made before or after a lien, judgment or levy, but the prior legal claim is superior for obvious reasons. Any government entity such as code enforcement, any third party, or any unsecured creditor can easily attach a lien, judgment or levy against your residential property or its equity for almost any reason, and sometimes without any notice to you. The homestead protection provided by us makes most liens or judgments void and unenforceable, but you must make the legal claim.
